These Terms of Use (the “Terms”) govern your use of the San Antonio's Web Design website and your purchase of any of our services. By using this site or purchasing a service, you agree to these Terms and to the specific agreement for the service you buy. Where a service has its own agreement (such as the Secure Managed Hosting Agreement), that agreement controls for that service.
1. General
All prices are in U.S. dollars. Payments are processed by Stripe; financing options such as Klarna or Afterpay may be offered at checkout where available and eligible. You are responsible for the accuracy of the information you provide and for the lawfulness of any content we host or work on for you.
2. Service Agreements
The following terms apply to each paid service:
Website Build Agreement
- One-time $299 fee (first-time customers save $50).
- Includes an agreed scope; extra pages or features are quoted separately.
- Up to two rounds of revisions are included after the first preview.
- Files/launch delivered after payment clears; hosting is optional and sold separately.
You are purchasing a one-time, sales-focused website build for a flat fee of $299.00 (a $50 first-time discount may apply). The build covers the scope agreed at intake; additional pages, integrations, or features beyond that scope are quoted separately. Two rounds of revisions are included after your first preview. Ongoing hosting, maintenance, and marketing are optional services sold separately. Deliverables are provided once payment has cleared. Financing via Klarna or Afterpay may be offered at checkout where available.
Website Maintenance Agreement
- $100/month, billed monthly and auto-renewing.
- Cancel anytime with written notice before the next billing date.
- Covers ongoing SEO, speed, monitoring and minor changes.
- Major redesigns or new features are quoted separately.
Website Maintenance is a recurring service billed at $100.00 per month. It includes ongoing SEO, speed optimization, outage monitoring, priority support, and minor content or layout changes. It does not include full redesigns or new feature development, which are quoted separately. The plan renews automatically each month until canceled in writing before the next billing date. Fees already billed are non-refundable.
Secure Hosting Agreement
- $100/month managed hosting with SSL, backups and malware protection.
- Month-to-month; cancel anytime with written notice.
- Target 99.9% uptime (not a guarantee of uninterrupted service).
- Separate from the 3-year 'Host with us' website hosting contract.
Secure Hosting is a month-to-month managed hosting service billed at $100.00 per month, including SSL, daily backups, CDN acceleration, firewall and malware protection, with a target uptime of 99.9% (a target, not a guarantee). You may cancel at any time with written notice before the next billing date. This month-to-month plan is separate from the discounted 3-year ‘Host with us’ website hosting contract, which has its own agreement and $99 buyout terms.
Ad Management Agreement
- Monthly management fee (Rookie $300 / Startup $500 / To The Moon $1,000).
- Advertising spend paid to Google/Meta is separate from our management fee.
- Month-to-month; cancel with written notice before the next cycle.
- We optimize campaigns but do not guarantee specific results.
Ad Management is a recurring service billed monthly at the selected plan rate (Rookie $300, Startup $500, or To The Moon $1,000 per month). This fee covers campaign setup, management, optimization and reporting only. Advertising spend (money paid to Google, Meta or other platforms) is billed separately and paid by you. We use commercially reasonable efforts to improve performance but do not guarantee any specific number of leads, sales, or return on ad spend. The plan is month-to-month and renews until canceled in writing before the next cycle.
IT Consulting & Repair Terms
- Billed per session or per quote provided before work begins.
- Diagnostic findings are estimates; final scope confirmed before major work.
- We are not responsible for pre-existing data loss; keep your own backups.
- Payment due on completion unless otherwise agreed in writing.
IT consulting, PC/mobile repair, data recovery and security-camera services are billed per session or per the written quote provided before work begins. Diagnostic findings are good-faith estimates and final scope is confirmed before major work proceeds. You are responsible for maintaining your own backups; we are not liable for pre-existing data loss or hardware failure. Payment is due upon completion unless otherwise agreed in writing.
3. Secure Managed Hosting Agreement (3-Year “Host with us” Plan)
Customers who choose the discounted 3-year “Host with us” plan accept the full Secure Managed Hosting Agreement, which includes the following:
This Secure Managed Hosting Agreement (the “Agreement”) is entered into between San Antonio’s Web Design (“Provider,” “we,” “us”) and the customer identified at checkout (“Client,” “you”). By checking the acceptance box and completing subscription checkout, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.
1. Services
Provider will host, maintain, and manage the Client’s website, including server hosting, SSL, routine security updates, daily backups, and reasonable support, for the Term. Setup and launch are provided at no additional charge.
2. Term & Auto-Renewal
The initial term of this Agreement is three (3) years beginning on the date hosting is activated. Upon expiration, this Agreement automatically renews for successive one (1) year terms unless either party cancels in writing before the then-current term ends. Fees for the hosting service are $100.00 per year, billed in advance.
3. Buyout / Early Termination
The Client may terminate the remaining Term at any time by paying a one-time buyout fee of $99.00. Payment of the buyout closes the account in good standing and ends all further billing and collection activity.
4. Payment, Late Fees & Default
Invoices are due upon receipt. A late fee of $50.00 will be added for every 30 days that any amount remains unpaid. An account is in default if payment is not received and the buyout has not been paid. Upon default, Provider may begin an automated reminder (dunning) process by email.
5. Collections & Escalation Fees
If the account remains 90 or more days past due, the Client agrees that an additional $500.00 in fees will be added to the balance owed to cover small-claims processing, Provider’s lost wages and administrative time, and court filing and service costs. The Client agrees these amounts are a reasonable estimate of Provider’s costs of collection and are recoverable in addition to the buyout fee, accrued late fees, and any court-awarded costs.
6. Legal Remedies
Provider may pursue any unpaid balance through the Justice Court (small claims) of Bexar County, Texas, and recover the full amount owed under this Agreement, including the buyout amount, accrued late fees, the $500 escalation fees, and court costs. The Client agrees that this Agreement, the invoices, and the dunning record constitute evidence of the debt.
7. Governing Law & Venue
This Agreement is governed by the laws of the State of Texas without regard to conflict-of-law rules. Exclusive venue for any dispute lies in Bexar County, Texas.
8. Limitation of Liability
To the maximum extent permitted by law, Provider’s total liability under this Agreement will not exceed the fees paid by the Client in the twelve (12) months preceding the claim. Provider is not liable for indirect, incidental, or consequential damages.
9. Data & Privacy
Provider handles Client data in accordance with its Privacy Policy. The Client is responsible for the lawfulness of content hosted and for maintaining its own copies of any critical materials.
10. Entire Agreement; Severability; Waiver; Assignment; Amendment
This Agreement is the entire agreement between the parties and supersedes all prior understandings. If any provision is held unenforceable, the remaining provisions remain in full force. Failure to enforce any provision is not a waiver. Provider may assign this Agreement to a successor. Any amendment must be made available in writing and continued use constitutes acceptance.
11. Acceptance
By checking “I have read and agree to the Secure Managed Hosting Agreement” and completing checkout, you agree to all terms above, including the 3-year term, the $50 per-30-day late fee, and the additional $500 in fees if your account becomes 90+ days past due.
4. Late Fees & Collections
For any recurring or contracted service, a late fee of $50.00 is added for every 30 days an invoice remains unpaid. If an account under the 3-year hosting contract is 90 or more days past due, an additional $500.00 in fees (small-claims processing, lost wages, and court costs) is added to the balance owed, and the balance may be pursued in the Justice Court of Bexar County, Texas.
5. Refunds
One-time build fees are earned as work is performed; recurring fees already billed are non-refundable. Nothing in these Terms limits any non-waivable rights you may have under applicable law.
6. Limitation of Liability
To the maximum extent permitted by law, San Antonio's Web Design's total liability for any claim will not exceed the fees you paid for the service giving rise to the claim in the twelve (12) months before the claim. We are not liable for indirect, incidental, or consequential damages.
7. Governing Law & Venue
This Agreement is governed by the laws of the State of Texas. Exclusive venue for any dispute lies in the Justice or District Courts of Bexar County, Texas.
8. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time of your purchase governs that purchase. Continued use of the site after an update constitutes acceptance of the updated Terms.
